Terms of Service

The App enables new and existing Clients to authorize The Aesthetic Generator LLC's Meta Business Manager (Business Portfolio ID: 2581418418854646) as a partner on their Meta advertising accounts. This authorization allows The Aesthetic Generator LLC to create, manage, and optimize Meta ad campaigns on the Client's behalf.

Once partner access is granted, The Aesthetic Generator LLC may, at the Client's direction, create ad campaigns, ad sets, and ad creatives within the Client's Meta advertising account. All campaigns are run within the Client's own advertising account and are billed directly to the Client's payment method on file with Meta.

The Aesthetic Generator LLC provides ongoing campaign optimization services including audience targeting adjustments, budget reallocation, creative testing, and performance reporting. Optimization recommendations are based on data retrieved from the Meta Marketing API and are subject to the Client's approval before implementation.

Authorized The Aesthetic Generator LLC administrators have access to a management dashboard that displays aggregated campaign performance metrics, client onboarding status, and optimization recommendations. This dashboard is for internal use by The Aesthetic Generator LLC staff only and is not accessible to Clients.

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use the App under any circumstances.

The App is intended for use by legitimate business entities and their authorized representatives. You represent and warrant that: (a) you are operating a lawful business; (b) your business and its advertising activities comply with all applicable laws and regulations; (c) your advertising content does not violate Meta's Advertising Policies or Community Standards; and (d) you have the legal right to advertise the products or services you intend to promote.

To use the App, you must have a valid Facebook account in good standing and comply with Meta's Terms of Service. You are solely responsible for maintaining the security of your Facebook account credentials. The Aesthetic Generator LLC will never ask for your Facebook password.

To grant partner access, you must have or create a Meta Business Manager account. If you do not have one, the App will guide you through the creation process. You are responsible for ensuring your Business Manager account is set up correctly and complies with Meta's Business Tools Terms.

By completing the onboarding flow and granting partner access, you authorize The Aesthetic Generator LLC's Business Manager (ID: 2581418418854646) to act as an advertising partner on your Meta ad account. This authorization grants The Aesthetic Generator LLC the ability to: (a) view your ad account settings and performance data; (b) create, edit, pause, and delete campaigns, ad sets, and ads; (c) manage your ad account budget and bidding strategies; and (d) access billing and payment information for reporting purposes only.

Partner access does NOT grant The Aesthetic Generator LLC the ability to: (a) access your personal Facebook profile or personal data beyond what is necessary for ad management; (b) make payments or charge your payment method directly; (c) transfer ownership of your ad account; (d) access any Facebook assets not directly related to the advertising services described herein; or (e) share your data with any third party except as described in our Privacy Policy.

You may revoke partner access at any time through your Meta Business Manager settings at business.facebook.com/settings/partners . Revoking access will immediately terminate The Aesthetic Generator LLC's ability to manage your campaigns. You remain responsible for any campaigns or ad spend incurred prior to revocation.

All marketing content, including ad creatives, copy, targeting parameters, and budgets, is ultimately approved by you (the Client) before being published. The Aesthetic Generator LLC will not publish any advertising content without your explicit approval unless you have granted standing approval in a separate written service agreement.

Advertise products or services that: (a) are illegal in the jurisdiction where they are offered; (b) violate Meta's Advertising Policies, including but not limited to prohibited content categories (weapons, drugs, adult content, discriminatory practices); (c) make false, misleading, or deceptive claims; (d) target protected classes in a discriminatory manner; (e) violate any applicable FTC, FDA, or other regulatory guidelines; or (f) infringe on any third party's intellectual property rights.

You may not: (a) use the App to circumvent Meta's advertising policies or platform restrictions; (b) attempt to gain unauthorized access to other users' accounts or data; (c) reverse engineer, decompile, or attempt to extract the source code of the App; (d) use automated scripts or bots to interact with the App; (e) resell or sublicense access to the App without written authorization from The Aesthetic Generator LLC; or (f) use the App in any manner that could damage, disable, or impair the App or Meta's platforms.

If you operate in a regulated industry (healthcare, pharmaceuticals, financial services, etc.), you are solely responsible for ensuring your advertising complies with all applicable regulations, including HIPAA, FDA guidelines, and state-specific healthcare advertising laws. The Aesthetic Generator LLC may require additional documentation before running campaigns in regulated categories.

The Aesthetic Generator LLC's service fees for advertising management are governed by the separate service agreement or statement of work ("SOW") executed between you and The Aesthetic Generator LLC. These Terms do not establish specific fee amounts; refer to your executed SOW for pricing details.

All Meta advertising spend is billed directly by Meta to your payment method on file with your Meta ad account. The Aesthetic Generator LLC does not collect, process, or hold any ad spend funds on your behalf. You are solely responsible for maintaining a valid payment method in your Meta ad account and for all charges incurred by your campaigns.

The Aesthetic Generator LLC's management fees are invoiced separately according to the billing schedule in your SOW. Invoices are due within the payment terms specified therein. Late payments may incur interest charges as specified in your SOW. The Aesthetic Generator LLC reserves the right to suspend services for accounts with outstanding balances exceeding 30 days past due.

Management fees paid to The Aesthetic Generator LLC are non-refundable unless otherwise specified in your SOW or required by applicable law. Ad spend paid to Meta is subject to Meta's own refund policies and is not within The Aesthetic Generator LLC's control. If you believe you were charged in error, contact us at [email protected] within 30 days of the charge.

You are responsible for all applicable taxes, duties, and levies associated with your use of the App and The Aesthetic Generator LLC's services, except for taxes based on The Aesthetic Generator LLC's net income. If The Aesthetic Generator LLC is required to collect taxes, they will be added to your invoice.

The App, including its design, code, features, functionality, trademarks, service marks, logos, and all content created by The Aesthetic Generator LLC (excluding Client Content as defined below), is owned by The Aesthetic Generator LLC and protected by U.S. and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for the purposes described in these Terms.

You retain all ownership rights to content you provide to The Aesthetic Generator LLC for use in your advertising campaigns, including images, videos, copy, logos, and brand assets ("Client Content"). By providing Client Content, you grant The Aesthetic Generator LLC a limited license to use, reproduce, and display such content solely for the purpose of creating and managing your Meta advertising campaigns.

The Aesthetic Generator LLC does not claim ownership of any creative assets, copy, automations, email templates, or other content delivered to you as part of the contracted services. Upon termination of services and full payment of outstanding fees, all deliverables created specifically for your campaigns become your property.

If you provide feedback, suggestions, or ideas about the App, you grant The Aesthetic Generator LLC a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without compensation to you.

You represent and warrant that all advertising content you approve for publication is truthful, accurate, and not misleading. You are responsible for ensuring that product claims, pricing, availability, and other representations in your ads are accurate at the time of publication.

You are solely responsible for ensuring your advertising content complies with all applicable laws, regulations, and industry standards, including but not limited to FTC disclosure requirements, FDA advertising guidelines for healthcare products, state consumer protection laws, and Meta's Advertising Policies. The Aesthetic Generator LLC may provide guidance but does not provide legal advice and is not responsible for regulatory compliance of your advertising content.

By approving any ad creative, copy, or campaign for publication, you take full responsibility for that content. The Aesthetic Generator LLC is not liable for any consequences arising from advertising content that you have approved, including but not limited to regulatory actions, consumer complaints, or reputational harm.

Any companies, organizations, or individuals referenced in The Aesthetic Generator LLC's materials as "Partners," "Referral Partners," or similar designations — including but not limited to LegitScript, Project Blue, TrueEval, and any other third-party service providers — are independent companies not owned by, affiliated with, or controlled by The Aesthetic Generator LLC.

The Aesthetic Generator LLC makes no representations or warranties regarding the services, products, qualifications, or conduct of any third-party partner. Any claims, fulfillment, services rendered, or disputes arising from your engagement with third-party partners are solely between you and that third party. The Aesthetic Generator LLC is not responsible for and expressly disclaims all liability for any loss, damage, or harm arising from your use of third-party services.

You are solely responsible for conducting your own due diligence before engaging with any third-party partner, including verifying their credentials, reviewing their terms of service, and assessing their suitability for your business needs. The Aesthetic Generator LLC's referral of a third party does not constitute an endorsement of that party's services or a guarantee of their performance.

Meta Platforms, Inc. is an independent third party. The Aesthetic Generator LLC is not affiliated with, endorsed by, or sponsored by Meta. Your use of Meta's platforms, including Facebook and Instagram, is governed by Meta's own terms and policies. The Aesthetic Generator LLC is not responsible for any changes Meta makes to its platform, advertising policies, or API that may affect the services provided hereunder.

THE APP AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE AESTHETIC GENERATOR LLC DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

The Aesthetic Generator LLC does not guarantee any specific advertising results, including but not limited to return on ad spend (ROAS), cost per lead, conversion rates, or revenue generated from campaigns managed through the App. Advertising performance depends on numerous factors outside The Aesthetic Generator LLC's control, including market conditions, Meta's algorithm changes, audience behavior, and the quality of your products or services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AESTHETIC GENERATOR LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR SERVICES, EVEN IF THE AESTHETIC GENERATOR LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The Aesthetic Generator LLC's total aggregate liability to you for any claims arising out of or related to these Terms or the services shall not exceed the total amount paid by you to The Aesthetic Generator LLC in the three (3) months immediately preceding the event giving rise to the claim, or $500, whichever is greater.

The limitations of liability set forth in this Section reflect a reasonable allocation of risk and are an essential basis of the bargain between you and The Aesthetic Generator LLC. The Aesthetic Generator LLC would not provide the App or services without these limitations.

You may terminate your use of the App at any time by: (a) revoking partner access through your Meta Business Manager settings; (b) disconnecting your Facebook account from the App; and (c) providing written notice of termination to The Aesthetic Generator LLC at [email protected]. Termination does not relieve you of any outstanding payment obligations under your SOW.

The Aesthetic Generator LLC may suspend or terminate your access to the App immediately, without notice, if: (a) you violate these Terms or our Acceptable Use Policy; (b) your advertising content violates Meta's policies or applicable law; (c) you fail to pay outstanding fees; (d) Meta suspends or restricts your ad account; (e) The Aesthetic Generator LLC determines, in its sole discretion, that continued service would expose The Aesthetic Generator LLC to legal, regulatory, or reputational risk; or (f) The Aesthetic Generator LLC discontinues the App.

Upon termination: (a) your license to use the App immediately ceases; (b) The Aesthetic Generator LLC will revoke partner access to your Meta ad account; (c) The Aesthetic Generator LLC will delete or anonymize your personal data in accordance with our Privacy Policy; and (d) all provisions of these Terms that by their nature should survive termination shall survive, including Sections 8, 9, 10, 11, 12, 14, and 15.

Before initiating any formal dispute resolution, you agree to first contact The Aesthetic Generator LLC at [email protected] and attempt to resolve the dispute informally. The Aesthetic Generator LLC will use commercially reasonable efforts to resolve any dispute within 30 days of receiving written notice.

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, with arbitration conducted in Virginia. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

YOU AND THE AESTHETIC GENERATOR LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights or unauthorized use of confidential information.
